PART I – GENERAL CONDITIONS

General provisions
These Terms of Use define the conditions of use of the Portal located at smartfirefighter.tech (“Portal”). The Portal Administrator provides, on the terms and conditions indicated in these Terms and Conditions and in accordance with the relevant provisions of Polish law, in particular with the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204), and with respect to consumers also with the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item. 827) – (“Consumer Rights Act”), the service of providing access to the resources of the information system – providing digital content, including the smartfirefighter.tech website, for the purpose of storing data in the form of forum entries, announcements, notes and comments on posts and articles and other services that are made available on the smartfirefighter.tech website

Basic conditions of using the Portal
The User and the Administrator enter into an appropriate agreement for the provision of services, which is done using appropriate interactive forms available through the Portal.

It is prohibited to use the Portal in a manner inconsistent with its purpose. It is prohibited to use the Portal for purposes that are contrary to Polish or international law, including in particular the provision of
unlawful content in Comments, Announcements, Forum posts or in any other form (which includes, in particular, the User’s name and login), including content that may be considered offensive, infringing third party rights (in particular intellectual property rights, including author’s economic or personal rights), third party personal rights, depicting or promoting violence, hatred, discrimination (racial, cultural, ethnic, religious, etc.).

It is forbidden to send unsolicited commercial information to the Users, i.e. information to which the recipient has not consented (spam) and to engage in commercial, advertising, promotional etc. activities without the consent of the Administrator of the portal.

Users of the Portal and other persons using it, in particular are obliged to:

respect the rights of the Administrator, Users and third parties, in particular the property and personal copyrights
refrain from any actions that would violate the privacy of the Users, especially those that consist in collecting, processing and disseminating information about them without their express consent, except when those actions are in accordance with the law and the provisions of these Rules and Regulations
not to take any actions to the detriment of the Administrator, the Users or any third parties.

The Administrator reserves the right to block the access to the Portal, in whole or in part, for the Users or other persons using it, whose actions are contrary to these Rules, or when it is required by the applicable law.

Conditions for concluding agreements and registering Portal users
Registration in the Portal is tantamount to agreeing to conclude an agreement with the terms of use of the portal as described in these Terms of Use, the Privacy Policy and the Cookies Policy published in the Portal. The Administrator is entitled to terminate the agreement at any time with immediate effect, which takes place by choosing the option to delete the User Account available in the settings via the interface available to the Administrator.
The Administrator does not take responsibility for false data provided by the User during the Registration process or later during the use of the Portal’s services. The Administrator has a right to make the provision of Services to the User dependent on his/her prior confirmation of his/her personal data, in particular by means of relevant documents. If the Administrator has reasonable doubts as to the authenticity of the data, he may refuse to conclude an agreement for the provision of Services, including the Registration of the User Account and posting a Comment, Advertisement or entry to the Forum in the Portal.

The use of a User Account for purposes other than those indicated in these Terms of Use is prohibited.
The consequences of sharing the User Account with a third party, including data/information enabling the use of the Portal in place of that User, shall be the responsibility of the account holder – the User who made the Registration.
Creating multiple User Accounts by a single User or by means of a single computer is prohibited (with the exception of a situation where this occurs with the Administrator’s consent after the interested persons have demonstrated that the Registration by means of the same computer is to concern different people) as well as the use of different User Accounts belonging to the same person in order to use the Portal.

In case of violation of the above rules of Registration or posting Comments, Announcements, Forum entries in the Portal, the Administrator reserves the right to block the User Account and remove all the data related to it from the Portal.
Unblocking the User Account is possible if the Administrator accepts the User’s explanation regarding the infringement by e-mail sent to the Administrator.
The Administrator reserves the right to completely remove the User Account together with all the related data in the event of the User’s inactivity during the last 12 months, i.e. when the User did not log in to the Portal successfully during that time.

If the Administrator receives an official notice or obtains reliable information about the illegal nature of the data contained in a Comment, an Advertisement or an entry in the Forum or activities related to them, the Administrator has the right to demand that the User immediately present his/her position and possible evidence of the legality of his/her actions to the Administrator,
under pain of deleting the User Account and entries posted to the Portal, as well as immediately blocking access to the User Account and entries posted to the Portal.
The Administrator exercises the rights referred to above at his own discretion, i.e. the Administrator does not have to call the User to a specific action before blocking the access to the User Account and the comments, postings or entries in the Portal.

Proprietary Rights and Licenses
All rights to the materials placed in the Portal are reserved. The content of the Portal cannot be copied, processed or modified for purposes other than personal use, nor shared with third parties. The Portal may contain photographs or graphic elements whose copyrights are held by the Users or third parties.

If the User places materials containing images of third parties in the Portal, the User declares and warrants that he/she has the authorization of the third party to use their images, and that the placement of the materials in the Portal will not violate the rights of the third party in any way. The Website User bears full liability to the Administrator for any damages which the Administrator incurred or may incur as a result of posting a Comment, Advertisement or entry to the Forum by that User.

Responsibility of the Portal Administrator
All the information published in the Portal is of non-binding informative character and does not constitute an offer as understood by the provisions of the Civil Code and cannot constitute a basis for any claims against the Administrator.
The Administrator shall not be held liable for the content and nature of the comments, announcements or Forum entries presented in the Portal. In this respect, the responsibility lies with the User who posted the given Comment, Advertisement or entry on the Forum.
The Administrator shall not be liable to third parties whose rights (in particular personal rights, copyrights or personal copyrights) have been threatened or violated by posting Comments, Announcements or entries on the Forum in the Portal. Responsibility in this regard shall be borne by the User who posted the entry.
If the Administrator receives an official notice or obtains reliable information on the illegal nature of the data contained in the Announcement or Comment, or related activities, it shall immediately block access to the Announcement or Comment on the Website.
The Administrator does not provide services in establishing friendship and is not responsible for disputes that may arise from the fact of establishing friendship between Users, as well as between Users and other persons, including visitors to the Portal.
The Administrator makes every effort to ensure the highest quality of the Services provided. However, the Administrator does not accept any responsibility for damage resulting from disturbances in the functioning of the Portal caused by force majeure, unforeseeable equipment failure or unauthorised interference by the Users or third parties, on which the Administrator has no influence.
The Administrator does not take responsibility for temporary inability of the Users to use the Portal’s functions, resulting from periodical changes and improvements in the Portal’s system.
Contents posted by the Users are not views and opinions of the Administrator. However, the Administrator reserves the right to: edit, shorten texts or remove contents prohibited by law, drastic, vulgar, offensive or otherwise violating the rules of the Portal specified in these regulations.
The Administrator does not take responsibility for actions of the Users and third parties, including for using by the Users or third parties, including visitors, data available in the Portal of other Users or third parties against the purpose of the Portal’s operation.

PART II – RULES OF USING FORUM, ADDING COMMENTS AND ANNOUNCEMENTS

General provisions
These Terms of Use define the rules of using the service provided by electronic means, which enables the use of an online discussion forum and commenting on materials published on smartfirefighter.tech website (hereinafter referred to as “Forum”).

The service referred to in the Terms of Service is provided by smartfirefighter.tech portal, hereinafter referred to as “Portal”.
The Service consists of enabling the publication (distribution) through the Forum or Comments under the materials published on the portal of the author’s ideas, opinions, comments, questions, information and other data, in accordance with the principles set out in the Rules. Whenever the Terms of Use refers to the Forum, without exceptions, it is agreed that analogous provisions shall also apply to comments added directly under any materials published in the portal.
Access to the Forum, the possibility to view entries and post comments is available to all adult Internet users visiting the portal (hereinafter referred to as “Users”), but underage users are not allowed to use the Forum.
By adding a comment, the User accepts the conditions specified in the Rules and undertakes to comply with the obligations arising from the Rules.
The Site has no obligation to distribute statements, content and data provided by the User.
The Portal retains the right to cease dissemination of all or only selected statements,
content and data made public by the User, and to prevent access to these statements, content and data on the Portal’s sites.
The Portal reserves the right to moderate the Forum and edit the content of comments and entries.
The User, who uses the Forum, cannot have any financial claims against anyone for this reason.
The user is entitled to stop using the Forum at any time, which does not deprive the Portal of the right to use the statements, content and data provided and disseminated by the User via the Forum.

Rules of use of the Forum
Users are obliged to use the Forum in accordance with the provisions of the Regulations and applicable law.
Users are obliged to refrain from distributing through the Forum any unlawful content.

It is forbidden to perform through the Forum any actions that violate universally applicable laws, in particular it is forbidden
a) disseminating content that violates the personal rights of third parties (including other Forum users) or threatens to violate such personal rights;
b) undertaking actions fulfilling the elements of a crime or inciting to commit a crime (including slander and defamation);
c) inciting racial, religious or ethnic hatred;
d) advocating violence and aggression;
e) promotion of alcohol, narcotics, drugs and pornography;
f) dissemination of advertising and promotional content;
g) dissemination of materials infringing (or threatening) copyright and related rights of third parties;
h) dissemination of materials infringing or threatening industrial property rights (including trademark or patent registration rights) or other rights of third parties;
i) infringing the rights of the portal’s publisher;
j) placing links to other websites that violate the provisions of the law
k) uploading chain-linked content;
l) dissemination of personal data, contact details, images, email addresses, etc;
m) dissemination of computer data that contains computer viruses or other destructive IT solutions;
n) dissemination of content that violates the rules and norms of social coexistence;
o) dissemination of vulgarisms, offensive, obscene content or content violating generally accepted ethical principles and rules of personal culture;
p) dissemination of spam.
The Forum is intended for distribution of content in the Polish language. The portal appeals to use Polish letters when creating comments and posts, and to use capital letters only in justified cases.
Users are obliged to publish on the Forum only content that is consistent with the topic of the commented material.
Publishing on the Forum commercial information within the meaning of the Act on Rendering Electronic Services (including advertising, promotional materials, PR messages, etc.) and other commercial content, without prior written consent of the Portal, is prohibited.
The same content (statements) cannot be published more than once and cannot be repeated in different places of the Forum. The Portal retains the right to remove duplicates and repetitions at any time.
It is unacceptable to publish questions or problems through the Forum with a request to send the answer to the individual e-mail address or through another channel of remote communication.
The Forum is intended for open exchange of information, publicly available to all Users.

Copyrights

Users are obliged to distribute through the Forum only content (statements) of their own authorship. In the case of use of the works or statements of other persons, Users are obliged to clearly indicate the quotation, in accordance with applicable law. Whenever the term “Work” is used, it shall be understood to mean any statement of the User’s authorship posted by him in the Forum, which may be considered a work within the meaning of the Act of 4 February 1994 on Copyright and Related Rights.
In return for rendering the service of enabling use of the Forum, User authorises the Portal to use the Work without time, territorial and quantitative limits, in all known fields of exploitation.

Additional provisions

The Portal is not responsible for the content of statements published in the Forum.
Each User bears sole and personal responsibility to the Portal and third parties for posting statements on the Forum that violate the law or the rules arising from the Rules.
According to Article 15 of the Act of 18 July 2002 on the provision of services by electronic means, the Portal is not obliged to check the data transmitted, stored or made available through the Forum. However, the Portal retains the right to control contents and data provided by Users for dissemination through the Forum, their editing and moderation, as well as to refuse their dissemination or cease further dissemination.
The Portal reserves the right to disclose the User’s identity or any information provided by the User, at the request of an authorised body, if criminal or civil proceedings are initiated against the User, having to do with the User’s activity in the Forum.
The portal will make every effort to ensure proper functioning of the Forum and provide assistance to Users in solving problems concerning its operation.
All problems related to the functioning of the Forum and violations of the Rules should be reported to the following address:
The Portal may suspend the activity of the Forum without giving any reason. The above will not result in any claims of Users against the Portal.
Using the Forum is tantamount to acceptance by the given User of the content of these Regulations, together with commitment of this User to comply with the Regulations in their entirety.

The Portal reserves the right to make changes to the content of the Rules.
All changes shall enter into force at the time of their publication.
